Introduction and Description of Document
These Terms and Conditions constitute, together with our Contract for the delivery of our services.
The words and expressions used below shall have the following meaning in the Contract:
French Touch Travel, Inc., or FTT (or deviations), signifies a corporation registered with the State of Florida, United States as a Seller of Travel under registration No. ST42281.
The Client signifies who is identified as our customer in the Contract.
The Services signify the travel that FTT shall render to the Client according to the Contract.
1. Services Provided
FTT offers travel planning and booking services, including but not limited to transportation, accommodation, tours, and other travel-related services.
All services are subject to availability and could be subject to additional terms and conditions imposed by third-party suppliers.
2. Contract and Pricing
- Upon approving the travel program, the Client will receive an enforceable Contract to be e-signed.
- FTT’s fees are stated in the Contract, which describes in detail the services offered. Prior to the beginning work, the Client has to sign the contract electronically or in writing to acknowledge the description of the services, the prices, along with these Terms and Conditions.
- The price quoted is valid for the hours stated on the Contract.
- After these hours, prices may fluctuate due to changes in availability or other factors determined by FTT and/or its suppliers
. - Once a Contract is confirmed, the price will remain fixed unless additional services are requested or there are changes to the original booking or there are significant fluctuations in exchange rate that may affect the final price. In any case, the Client will be informed of any adjustments necessary due to these changes.
3. Payment Obligations
- FTT’s Contract and Proforma Invoice are due for payment at the time of signature.
- Deposit and payment schedule:
- 30% non-refundable first payment at the time of contract signed.
- 40% non-refundable second payment due three (3) months prior to departure date.
- 30% non-refundable final balance due to two (2) months prior to departure date.
- For contracts signed within two (2) months of departure date, 100% of the Contract price is due at the time of the contract being signed.
- Payments can be made via Wire Transfer, ACH, Zelle, and Credit Card.
- A Contract signed less than two (2) months before the departure date cannot be paid by Credit Card.
- All payments made to FTT are non-refundable under any circumstances. This includes, but is not limited to, cancellation, changes in travel plans, or refusal of services by third-party providers.
4. Credit Card Processing
- All payments made via Credit Card require the completion and signing of a Credit Card Authorization Form provided by FTT. This form authorizes FTT to charge the credit card for the agreed-upon services.
- The Credit Card Authorization Form must be signed by the Cardholder.
- Payments made via Credit Card are subject to a 3% processing fee, which will be added to the total contract value.
- FTT ensures that all Credit Card information is handled securely and will be used solely for the purpose of processing the Client’s payment upon the Client’s consent and will not be disclosed to any unauthorized third parties.
- To prevent fraud, FTT or FTT’s credit card processing partner may require additional verification or documentation to confirm the identity of the Cardholder and the Client.
- By signing the contract and using Credit Cards for payment, the Client agrees to these terms. If the Client does not agree to these terms, they must choose an alternative payment method.
5. Changes and Cancellations
- Any request for changes to Client’s booking is subject FTT’s consent, the availability and the Terms and Conditions of the third-party suppliers. Additional charges may apply.
- Certain booking arrangements may not be changeable after reservation and could incur cancellation charges up to 100%.
- Due to the non-refundable nature of payments, no refunds will be issued for cancellations by the Client.
6. Travel Insurance
- FTT strongly recommends that the Client purchases comprehensive travel insurance to cover potential risks including trip cancellation, medical emergencies, lost luggage, and other unforeseen events. FTT does not provide travel insurance and is not liable for any losses not covered by their insurance policy.
7. Data Protection
- FTT ensures that all processing of personal data is conducted in compliance with relevant data protection laws and regulations of the State of Florida.
- Personal data collected by FTT will only be used for the purposes of facilitating our travel services. Therefore, it may be shared with other third-parties for these purposes.
- By providing personal data to FTT, the Clients warrant that they have obtained any necessary consent by other individuals who will travel with them.
- Personal data will be retained by FTT for as long as necessary to fulfill the purposes for which it was collected, including maintaining business relationships with the Client and meeting legal requirement.
8. Limitation of Liability
- FTT acts solely as the Client’s travel agency and will offer prompt assistance within our capacity if the contract is not performed or is improperly performed due to third-party’s (hotels, tour operators, tourist sites management board, transportation suppliers, etc.) failures. However, FTT is not responsible for and do not assume any liability for any injury, damage, death, loss, accident, delay, or irregularity which may be caused by any act or omission of any third-party or any failures due to unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised.
- Travel involves inherent risks, including but not limited to health hazards, acts of nature, transportation accidents, and political instability. By using FTT’s services, the Client acknowledges and accepts these risks and agree that FTT is not liable for any damages or losses that may occur.
9. The Client's Rights
- The Client has the right to receive clear and accurate information about the travel services offered by FTT, including the total price, itinerary details, and any Terms and Conditions associated with the booking.
- Should the Client encounter any issues during his travel, we encourage them to promptly inform the relevant supplier, such as their hotelier, and reach out to our client service helpdesk without delay, especially while the Client is still at the resort. The Client can call, send text messages, online messages, to the phone number or email that has been given to the Client to serve this purpose. Failure to follow this process may impact our ability to rectify the issue during his stay and could affect his rights under the Contract.
10. The Client's Responsibilities
- As a client of FTT, the Client are responsible for making timely payments for his travel services in accordance with the agreed-upon payment schedule. Failure to make payments on time may result in the cancellation of their booking.
- The Client must comply with all applicable laws, regulations, and travel requirements of the countries they visit, including but not limited to immigration, customs, health, and safety regulations. FTT is not responsible for any penalties, fees, or additional costs incurred due to their failure to comply with these requirements.
- The Client is responsible for familiarizing himself with and complying with the Terms and Conditions outlined by FTT, as well as those of our third-party suppliers. This includes adhering to cancellation policies, travel requirements, and code of conduct guidelines.
- The Client is responsible for maintaining awareness of their surroundings and adhering to any safety instructions provided by FTT or third-party suppliers. This includes following local laws and regulations, practicing caution in unfamiliar environments, and taking necessary precautions to ensure their own safety and security.
- The Client is responsible for their own actions and well-being during travel. FTT is not liable for any injuries or accidents that occur as a result of their actions, negligence, or failure to follow safety instructions.
11. Disorderly Behavior
- FTT reserves the right to terminate the Contract of any client whose behavior poses a threat or annoyance to others. If his conduct impedes travel or causes discomfort to fellow passengers, FTT staff or any third parties’ suppliers, our responsibility for his travel ceases. Disruptive or inappropriate behavior (including under the influence of drugs or alcohol) may result in termination of his contract and removal from the tour or accommodation, without refund.
- FTT has no control over the behavior of other individuals at the Client's accommodation during his travel. Additionally, FTT prohibits subletting, sharing, or assigning his accommodation.
12. Amendments
- FTT reserves the right to amend these Terms and Conditions at any time without prior notice. Any such amendments will be effective immediately upon posting on our website or otherwise providing notice to the Client. The Client’s continued use of our Services following the posting of amended Terms and Conditions constitutes his acceptance of the changes.
13. Choice of Law and Legal Venue
- The Contract and these Standard Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida. Any disputes arising from the Contract shall be settle by the ordinary court where FTT is located.
